The following SMS/text-messaging terms apply to all mobile messaging programs operated by San Ramon Auto Repair. Program Description

San Ramon Auto Repair operates two optional SMS programs:

• Non-Marketing SMS Program: Transactional and operational messages including appointment confirmations, service updates, repair status notifications, estimate approvals, pick-up notices, account notifications, customer support replies, and service reminders.
• Marketing SMS Program: Promotional messages including special offers, seasonal discounts, service promotions, and updates about San Ramon Auto Repair.

Consent to receive SMS messages is not a condition of purchase. Message frequency varies based on your interactions with us and the program you opt into.

How to Opt In

You may opt in by checking the applicable SMS consent box on our Contact form or by providing your mobile number and affirmatively agreeing during a service interaction. Each program requires a separate, unchecked, optional opt-in. We do not pre-select consent and we do not opt you in automatically.

Cancellation Instructions (STOP)

You can cancel the SMS service at any time. Reply STOP to any text message you receive from San Ramon Auto Repair. After you send STOP, we will send you a confirmation message and will not send you any additional messages from that program. If you want to join again, simply opt in again as described above.

Carrier Liability

Message delivery is subject to the effective transmission from your wireless service provider/network operator and is outside of our control.

Message & Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider. Message frequency may vary.

Supported Carriers

The SMS programs operate on all major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Google Fi, and most other carriers. Carriers are not liable for delayed or undelivered messages.

Age Restriction

You must be 18 years of age or older to opt in to and participate in any San Ramon Auto Repair SMS program.

Privacy Policy Reference

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL San Ramon Auto Repair, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

11. Indemnification

You agree to defend, indemnify, and hold harmless San Ramon Auto Repair and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party right.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Contra Costa County, California. You and San Ramon Auto Repair each waive any right to a jury trial or to participate in a class action. If any portion of this arbitration clause is found unenforceable, the remainder shall remain in effect.
